Charged with a DUII – Information You Need to Know

You made a mistake.  Now you are facing charges that could ruin your driving record, cost you your driver’s license, send you to jail or prison, and/or cost you thousands of dollars in fines and spiked insurance rates.  However, there is hope.  In the state of Oregon, eligible drivers charged with Driving Under the Influence of Intoxicants (DUII) can choose to participate in a Diversion Program, which upon completion, dismisses the offense.   Therefore, it is important to understand the law and to know your options when faced with a DUII in Oregon.

What’s at Stake?
The maximum penalty in Oregon for a Misdemeanor DUII is one year in jail, a $6,250.00 fine, and five years probation.  The minimum fine is $1,000.00.  Additional costs, such as increased insurance rates and lost wages can have a significant financial impact.  These daunting repercussions mean that it is paramount that you secure an experienced DUII attorney.

Charges Defined
Legal terminology varies by state, however, in Oregon, DUII is the accepted term.  DUII means that a driver is impaired by drugs or alcohol, specifically “Driving Under the Influence of Intoxicants.”  Other states refer to DUII, DUI, and DWI as acronyms that have the same meaning.  Specific variations, such as DUID and DUII-CS, are used for situations when a driver is arrested for driving while under the influence of intoxicants (e.g., controlled substances, such as marijuana).

Felony DUII
The charge of felony DUII is applied to individuals who have been convicted of DUII three or more times in the past ten (10) years.  These convictions carry a much more severe penalty, including a possibility of five (5) years in prison, and a lifetime revocation of your driver’s license.  The DUII laws in Oregon have been created to protect innocent drivers.

Bottom Line
The DUII law in Oregon is very complex, and fraught with daunting repercussions and severe penalties.  It composes such a large amount of criminal casework that many jurisdictions have created separate court systems entirely devoted to drunken driving charges.  Because of this, and the severity of the punishments, it is very important that you have an experienced DUII attorney represent your case.  At Gilroy & Napoli, we are experts in Oregon DUII law, having prosecuted and defended a vast number of DUII cases.  You can be assured that we will provide sound advice to help you meet your goals.
